Time Is Running Out To Claim Back Your Miss-sold PPI

PPI claims are big news and by now you probably have heard of people getting back large sums of money. Recently many people across Northern Ireland have been tortured by phone calls, text messages and emails made by companies claiming they can help you recoup your PPI, but although they claim that they offer a no win, no fee service the reality is that many of them will charge you up to 30% of your claim money if they do manage to get your money back. Not good when you can claim back 100% for yourself.

Statistically about 36% of the population here in Northern Ireland have been miss-sold these policies over the last 10 years or so and on speaking to many people in the Banbridge area I am amazed how many people don't know, don't care or just can't be bothered to check if they are one of them.

Why would you not want to get your own money back?

Seriously, it is not difficult to find out if you are due a rebate and requires very little effort!

So what is the PPI scandal all about?

Financial Institutions including Banks, Brokers, High Street Retailers, Loan and Credit Card providers have routinely miss-sold PPI for an number of years to those for whom the insurance policy is inappropriate or unnecessary and then charged extortionate rates for this insurance over a period of time. In 2009 these institutions and banks were taken to court by the financial regulators and lost a legal case and must now settle and refund the miss-sold payment protection policies.

As a result of these proceedings, big name banks and lenders such as Alliance & Leicester, Egg, Capital One and HSBC have been fined millions of pounds by the courts and have set aside roughly 10 billion pounds to refund this money which is rightfully their clients.

Unfortunately many people are unaware they were even charged for PPI as many providers just had a tick box exercise on their forms and thus why a number of companies in the UK have been setup to help people reclaim this insurance.

So what is PPI?

PPI stands for Payment Protection Insurance and is an insurance policy specifically created to help you keep up with your loan or credit card repayments in case you find yourself unable to work due to Accident, Sickness or Unemployment. It was designed to cover your monthly loan or credit card payments (or a percentage of them) if you could not meet your repayments due to being unable to work. PPI applies to those who cannot work due to illness, injury caused by an accident, or those who have been made redundant.

Payment protection insurance has many different names and the wording in some documents can be quiet ambiguous: loan protection insurance, MPPI, PPI among others. Whatever type of plan you took out, it may be possible to claim your money back.

So who is affected?

Up to 20 million people in the UK have been potentially been mis-sold Payment Protection Insurance (PPI) or Accident, Sickness and Unemployment Insurance (ASU) and are eligible to make PPI claims! You could be one of them! Unknown to you up to 40% of your monthly payments on loans, credit cards, mortgages and any financial deals could unnecessary and be costing you money!
If you have taken out PPI, there is a chance it may have been miss-sold to you. This means that you may be entitled to claim compensation. With an average pay-out in excess of £2,500, it’s worth checking to see whether you did take out PPI on your financial transactions and whether you can make a PPI claim as you may be able to pay off existing debts or even take a well-earned break.

Many people just could not bothered reclaiming, which is silly as they could claim back a small fortune by spending a few minutes looking though their financial documents.

PPI claims are about the sale and not the product.

There is nothing inherently wrong with payment protection insurance. The issue is the way in which it was miss-sold to consumers.

Some people rely on payment protection to cover them if they are unable to work due to accident, sickness or unemployment. However, many people are ineligible to claim on the policy, perhaps because they are self-employed, government employees or they have pre-existing medical conditions. There are a whole host of reasons why you may be excluded from making a claim on the policy and every case has its own particular circumstances. You may need legal advice if you are not sure!

How do I know if I have taken out PPI?

Many people are totally unaware that they have even taken out Payment Protection Insurance and therefore it’s worth checking all of your financial agreements to find out if you have in fact been paying it.

The best way to find out whether or not you have taken out Payment Protection Insurance (PPI) is to check your original credit or loan agreements. It should be stated on the agreement as a separate cost. If these documents are not available then a simple call to your Bank or Lender asking for your account details should enable you to find out whether you can submit a claim or not. In the case of credit cards, if you have an outstanding balance, it will usually show on your monthly statements.

Am I entitled to claim back my PPI?

If you have taken out a loan, mortgage or credit card from today’s date six years ago till mid-2009 and the lender also advised you to take out PPI, you can reclaim these premiums if you feel that the policy was miss-sold to you. There is a legal case to reclaim your payments that are older than six years old if you have just recently repaid the above or are in the process of doing so, but you will need to seek legal advice on this.

There are myriads of reasons why you may have been miss-sold PPI, below are the most common ones. To establish whether PPI was suitable for your needs, if you can answer “yes” to any of the following questions then you may be entitled to claim compensation:
•	The cost of the policy was not explained to you
•	You were not in full-time employment at the time or were self-employed
•	You had existing cover through your employer
•	The policy was added without your knowledge
•	You were told that you had to take out PPI or else you could not get the loan or card

In order to successfully reclaim PPI, it’s useful to know the grounds for miss-selling and how to present a case to your lender.

How long will my claim take?

Most cases are dealt with within 8-12 weeks of receipt of your signed documents. The Financial Services Authority (FSA) insist that all cases are investigated within this timeframe, but if your provider cannot keep to this deadline then you may need help to liaise with the relevant authorities to ensure a swift settlement to your claim.

Will making a claim affect my relationship with the provider?

No. If you have been miss-sold a product you are fully entitled to claim back your money.

So how do I claim back my PPI?

The average claim in Northern Ireland is between £2,500 and £5,000 and that in itself is interesting. This means that a large majority of cases are above £3,000 which means they fall under the jurisdiction of the larger courts and not the small claims courts, this means that if you are claiming back PPI above this amount that you can hire a lawyer to look at your case and they will be paid by the defendant if your claim is successful. You as the Claimant or Plaintiff pay nothing and thus receive 100% of your money back. So why would you want to pay 15%- 30% out to anybody to claim back your own money, when you basically can hire a lawyer for free?

There also has one other major advantage to this course of action. If you are not a mathematician and are not good with numbers, the lawyers can work out exactly what you are due. PPI reclaim is a complicated business and is not as straight forward as meets the eye as it not only involves an initial amount in some cases, but can involve compounded interest as well. There is also the case of how much money you would have had if what you have paid out PPI and the money was still in your pocket and of course damages.

If you claim is less than £3,000 then unfortunately if it were to go to court then you would be in the position to pay for legal fees by yourself as this is legally a small claim. However not all is lost! Many lenders will make you an offer if you are due back PPI and will pay you out directly all it takes is a few letters from you and you will still get back your money. However if you do want to use a claims company, many will charge you 15% - 30% of your claim, while legal fees could be between £300 -£500 depending on your case if you use a lawyer. Both options are worth consideration.

However there are companies that will do a free scan of your accounts and can advise you how much PPI you can reclaim and I would always advise this is a good starting point.

What to do next!

If you think that you are due a repayment of PPI or are just unsure, get as much detail of your account as you can. A quick telephone call or a rummage through your papers will yield dividends,

To get a free scan done you will need: -
1. Your Name and Address
2. Name of your lender
3. Account Type i.e. Mortgage, Loan, Credit Card, Car Finance etc.
4. If you know you have PPI on your account this is helpful, but a free scan will reveal if you do or don’t if you are unsure!

Once you have these give me, Alan Mitchell a call on 074 1424 6364 or email me at alanmitchell64@hotmail.co.uk and I will make an appointment to chat to you about how to set about reclaiming your PPI if you need help by completing a free, quick, no obligation form with you.

Finally to reiterate how to reclaim

• All you need to have are the details of your financial credit deals- i.e. credit ards, mortgages and loans in the past 6 years or so paid off or still being paid that have PPI or ASU protection. If you don’t know I can help you find out by complete a free no obligation survey!

• The information you give me is forwarded to a Legal Firm, who will appoint a panel lawyer who will contact you directly and advise you if you are eligible to claim and how much your claim is worth and the best ourse of action to take.

If you found this article useful please tell your family and friends as they too may be able to claim back money.
